CookItFor.Us, Inc., a Deleware corporation (“Company”), doing business as CookItFor.Us makes this website, CookItFor.Us, (the “Site”), including all information, documents, communications, profiles, files, text, graphics, software, products and services available through the site (collectively, the “Materials”) and all services operated by Company and third parties through the site (collectively, the “Services”), available for your use subject to the terms and conditions set forth in this document and any changes to this document that Company may publish from time to time (collectively, the “Terms of Use”). By accessing or using this Site in any way, including, without limitation, use of any of the Services, conducting Craver/Maker profile searches, creating Craver/Maker profiles, downloading of any Materials, or merely browsing the Site, you agree to and are bound by the Terms of Use. Company reserves the right to change the Terms of Use and other guidelines or rules posted on the Site from time to time at its sole discretion. Your continued use of the Site, or any Materials or Services accessible through it, after such notice has been posted constitutes your acceptance of the changes. Your use of the Site will be subject to the most current version of the Terms of Use, rules and guidelines posted on the Site at the time of such use. You should periodically check these Terms of Use to view the then current terms. If you breach any of the Terms of Use, your authorization to use this Site automatically terminates.

CookItFor.Us Food Policy Overview

Food safety should always be your first priority. All Cravers and Makers should familiarize themselves with all relevant federal, state, and local laws and regulations regarding the production, sale, and distribution of food items.

When you list a food item, you are certifying that you have met all relevant food safety conditions and requirements, including, but not limited to:

  1. Ingredients: Certain Federal and State laws require labels on some food products to state, among other things, the food's ingredients, nutrition information, and place of manufacture.
  2. Food licenses: Almost all states require food manufacturers and sellers to register with or obtain a license from the state, or local government body.
  3. Import/export: Laws restrict the import and export of many food products.

Basic Terms & Conditions

We're Not Perfect. We're In Beta - Please understand that not everything on the CookItFor.Us site works perfectly yet, that's why we're in Beta. We are all learning together, and kindly ask for your patience and ongoing feedback so that we can work together to improve the CookItFor.Us experience. As such, we ask that you agree not to hold us responsible for any site failings, and we agree to try to fix things to the best of our abilities.

  1. CookItFor.Us is Only A Marketplace with limited Responsibility - CookItFor.Us is an open marketplace that lets Cravers connect with Makers. CookItFor.Us does not produce or sell any of the recipes or food featured on the site, nor do we guarantee/warrant the foods, recipes and services offered in any way. Our involvement is limited to taking orders and transacting payments between Cravers and Makers, and that’s where our responsibility ends. Consequently, CookItFor.Us does not transfer legal ownership of items from the Maker to the Craver. CookItFor.Us cannot guarantee the true identity, age, and nationality of a user. CookItFor.Us encourages you to communicate directly with potential transaction partners through the tools available on the Site. We do not endorse or control any Maker or Craver on this site, their quality, or any physical harm food items may cause. We will not be liable for any physical injury, or any loss whatsoever, resulting from your interaction with this site, Cravers, Makers or any food items. Makers and Cravers are responsible for paying, collecting and making all necessary tax payments to local, state and federal entities.
  2. Your Health & Safety is Always Your Responsibility – Please exercise common sense and due diligence when listing and ordering food items, or meeting people that you have connected with on this site. We do not screen Cravers or Makers in any way, or validate any of their claims or representations. Makers are required to confirm that they comply with all Local, State, and Federal guidelines related to the production, sale and distribution of food –however we do not verify or validate any of these claims. Makers and Cravers are responsible for researching and ensuring compliance with relevant laws and regulations. You should personally verify any Allergen related claims with the Maker. We reserve the right to hold you liable, and you understand that you will indemnify CookItFor.Us for any loss we may experience as a result of your violation of any laws or regulations.
  3. Handcrafted Foods Vary - Pictures, measurements, and comments used to describe food may not be exact representations, and should be considered approximations. Food items are handcrafted and may naturally vary each time they are produced. Measurements may not be exact, and serving sizes are bound to vary. While recipes drive the service, Makers may vary ingredients and preparation. Discuss these variances with Makers you select to transact with, before making your purchase.
  4. Allergy Alerts - We make no guarantees that foodstuffs will be free of allergens or will be allergy compliant. We do not screen Makers, their facilities, ingredients or food products. Makers that list that they offer Allergen free foods are 100% responsible for ensuring that they do so in accordance with generally acceptable industry standards, throughout the manufacturing and distribution process. Please refer to Point #3 above – Your Safety is Your Responsibility. Please exercise the proper level of due diligence to stay safe.
  5. Dispute Resolution - Any disputes and disagreements that occur between Cravers and Makers will need to be resolved between those same individuals. CookItFor.Us will not intervene on either party’s side, except to process adjustments that both parties have agreed to, involving their own goods, cash or services, less any reasonable service fees that CookItFor.Us has incurred. This resolution will only occur based on written direction from both parties.
  6. Recipe & Other Site Content - Recipes shared on this site by Cravers and Makers are the property of their respective creators. Our goal is to drive traffic back to the sites where these recipes originated, and to provide proper attribution. If you are a recipe owner, and would like your recipe(s) removed, please contact us using the information in the Contact Us section of this site. We will do our best to remove it in a timely manner. You hereby grant CookItFor.Us the unlimited right and permission to comment publically on your Craver or Maker Profiles, and any site forums. You will have no right of approval, no claim to compensation, and no claim relating, without limitation, to claims based upon privacy, defamation or right of publicity, arising out of any such use.
  7. Pricing, Currency & Payment - Joining and setting up a Craver/Maker profile on CookItFor.Us is free. CookItFor.Us charges the Maker a percentage of the sale price when an item sells (currently 15% added to originally listed price). Changes to the pricing for CookItFor.Us services are effective after CookItFor.Us provides you with at least fourteen (14) days' notice by posting the changes on the Site. While CookItFor.Us is available on the web and all citizens of the world, our transaction currency is limited to U.S. Dollars. All prices listed on the site are in U.S. dollars, and all transactions will be charged to your preferred payment method in U.S. Dollars. Makers may not charge excessive handling fees or otherwise avoid fees. Makers may not alter the item's price after a sale for the purpose of avoiding CookItFor.Us’ transaction fees. Merchant Services: CookItFor.Us facilitates the purchase of items bought and sold by Users on the Site using PayPal Payment Services. Complete details of PayPal’s Terms of Use can be found here https://www.paypal.com/cgi-bin/webscr?cmd=p/gen/terms-outside . Upon the sale of an item listed on the Site, authorized payments from the User are transferred to a Maker’s account less any applicable commission, transaction fee, and/or other adjustments. Payment: CookItFor.Us will initiate the transfer of the entire outstanding balance on the 15th of every month. The outstanding balance will include any transaction you received from authorized payment methods by Users, less any commission, transaction fees, refunds, credit card chargebacks, and/or other adjustments. Termination: If CookItFor.Us terminates your account, if you close your account, or if the payment of your CookItFor.Us commission and transaction fees cannot be completed for any reason, you remain obligated to pay CookItFor.Us for all unpaid fees plus any penalties, if applicable. Here are some examples of how Payments work:

Craver:

If a Craver purchases a Make that hasn't hit its minimum we authorize a payment for the total amount shown. If the Makers total purchases for that bid reaches the minimum, the Cravers authorization will be acted upon for the total of the authorized amount. If a Maker doesn't reach a minimum quantity of that bid, the authorization is canceled and no money is transacted.

If a Maker's bid minimum has been met, a Craver is instantly charged for the total amount shown and no authorization takes place.

Makers:

Makers are paid every Sunday for payments based on each bid. For example if a Maker has two bids on two separate recipes, both bids have met their minimum, the maker would receive two payments, one for each bid.

Example 1:

A Makers bid on a soup during the first week generates 10 cravers at $10 each total with the 10th item being craved on Saturday. The Makers minimum was 10 items. On Sunday, that Maker would receive a deposit of $100 in their PayPal account.

Example 2:

A Makers bid on a soup during the first week generates 10 cravers at $10 each total with the 10th item being craved on Saturday. The Makers minimum was 20 items. On Sunday, that Maker receives $0 because their minimum was not met. On the last day of the bid (2nd week), the Maker reaches their minimum. That Sunday, they would receive payment of $200.

Example 3:

A Maker’s bid on a soup during the first week generates 15 cravers at $10 each total with the 10th item being craved on Saturday. The Maker’s minimum was 10 items. On Sunday, that maker would receive a deposit of $150 in their PayPal account. During the second week of the crave, an additional 5 cravers order that Maker’s bid. At the end of that week on Sunday, $50 would be released to the maker.

Example 4:

A Maker’s bid on a soup during the first week generates 10 cravers at $10 each total with the 10th item being craved on Saturday. The Maker’s minimum was 10 items. They also have a bid on bread that has generated the minimum quantity of 15 items at $5 each. On Sunday, that maker would receive a deposit of $100 for the soup and $75 for the bread in two separate transactions.

Example 5:

Based on what the Maker bids we add 15% to the cost for each purchase as a handling charge. We ONLY charge based on the price per item. Tax & shipping fees are based off the original price.

Example 6:

A Maker bids on a recipe at $10 each. They also set the shipping for $5 for the first item, and $1 for each additional. Their tax rate for their area is 4%.
The total cost for the item prior to shipping and tax is $11.50.
With tax it is $11.90
If a craver orders just one item the total will be $16.90.
If a craver orders three items, the total will be $42.70. ($30.00 base + $4.50 CIFU fee + $1.20 tax + $7.00 shipping)

  1. All Sales Final – All Sales are considered final once the transaction has been completed. Agreeing to purchase or make a recipe is a contractual obligation between the Craver and Maker. Please honor your commitments. All sales are binding. The Maker is obligated to ship the order or otherwise complete the transaction with the Craver in a prompt manner, unless there is an exceptional circumstance, such as: (a) the Craver fails to meet the terms of the Maker’s listing (such as payment method), or (b) the Maker cannot authenticate the Craver’s identity. The Craver is obligated to deliver appropriate payment for items purchased, unless there is an exceptional circumstance. Right to Refuse Service - CookItFor.Us reserves the right to temporarily or indefinitely suspended CookItFor.Us members, to cancel unconfirmed or inactive accounts, or to refuse service to anyone, for any reason, at any time.
  2. CookItFor.Us’ Intellectual Property - CookItFor.Us, and other CookItFor.Us graphics, logos, designs, page headers, button icons, scripts, and service names are registered trademarks, trademarks or trade dress of CookItFor.Us, Inc. in the U.S. and/or other countries. CookItFor.Us’ trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names or email addresses, in connection with any product or service in any manner that is likely to cause confusion.
  3. Access and Interference - Much of the information on CookItFor.Us is updated on a real-time basis and is proprietary or is licensed to CookItFor.Us by CookItFor.Us’s users or third parties. You agree that you will not use any robot, spider, scraper or other automated means to access CookItFor.Us for any purpose without CookItFor.Us's prior express written permission. Additionally, you agree that you will not: Take any action that imposes, or may impose, in CookItFor.Us’s sole discretion, an unreasonable or disproportionately large load on CookItFor.Us’s infrastructure; Copy, reproduce, modify, create derivative works from, distribute or publicly display any user Content (except for your Content) from the Site without the prior expressed written permission of CookItFor.Us and the appropriate third party, as applicable; Interfere or attempt to interfere with the proper working of the Site or any activities conducted on the Site
  4. Breach - Without limiting any other remedies, CookItFor.Us may, without notice, and without refunding any fees, delay or immediately remove Content, warn CookItFor.Us’s community of a user's actions, issue a warning to a user, temporarily suspend a user, temporarily or indefinitely suspend a user's account privileges, terminate a user's account, prohibit access to the Site, and take technical and legal steps to keep a user off the Site and refuse to provide services to a user if any of the following apply:

CookItFor.Us suspects (by information, investigation, conviction, settlement, insurance or escrow investigation, or otherwise) a user has breached this Agreement, the Privacy Policy, or other policy documents and community guidelines incorporated herein; CookItFor.Us is unable to verify or authenticate any of your personal information or Content; Or CookItFor.Us believes that a user is acting inconsistently with the letter or spirit of CookItFor.Us’s policies, has engaged in improper or fraudulent activity in connection with CookItFor.Us or the actions may cause legal liability or financial loss to CookItFor.Us’s users or to CookItFor.Us.

  1. Privacy - Except as provided in CookItFor.Us’ Privacy Policy, CookItFor.Us will not sell or disclose your personal information (as defined in the Privacy Policy) to third parties without your explicit consent. CookItFor.Us stores and processes Content on computers located in the United States that are protected by physical as well as technological security.
  2. No Warranty - COOKITFOR.US, COOKITFOR.US’S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AND COOKITFOR.US’S SUPPLIERS PROVIDE COOKITFOR.US’S WEB SITE AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. COOKITFOR.US, COOKITFOR.US'S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES AND COOKITFOR.US’S SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, PERFORMANCE, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IN ADDITION, NO ADVICE OR INFORMATION (ORAL OR WRITTEN) OBTAINED BY YOU FROM COOKITFOR.US SHALL CREATE ANY WARRANTY. SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE FOREGOING DISCLAIMER MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE.
  3. Liability Limit - IN NO EVENT SHALL COOKITFOR.US, AND (AS APPLICABLE) COOKITFOR.US’ SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES OR COOKITFOR.US’S SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, COMPENSATORY, CONSEQUENTIAL, AND/OR INCIDENTAL, ARISING OUT OF OR RELATING TO THE CONDUCT OF YOU OR ANYONE ELSE IN CONNECTION WITH THE USE OF THE SITE, COOKITFOR.US’S SERVICES, OR THIS AGREEMENT, INCLUDING WITHOUT LIMITATION, LOST PROFITS, BODILY INJURY, EMOTIONAL DISTRESS, OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES. COOKITFOR.US’S LIABILITY, AND (AS APPLICABLE) THE LIABILITY OF COOKITFOR.US’S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO THE GREATER OF (A) THE AMOUNT OF FEES YOU PAY TO COOKITFOR.US IN THE 12 MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY, AND (B) $100. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
  4. Indemnity - YOU AGREE TO INDEMNIFY AND HOLD COOKITFOR.US AND (AS APPLICABLE) COOKITFOR.US’S PARENT, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, AGENTS, AND EMPLOYEES, HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING REASONABLE ATTORNEYS' FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR BREACH OF THIS AGREEMENT OR THE DOCUMENTS IT INCORPORATES BY REFERENCE, OR YOUR VIOLATION OF ANY LAW OR THE RIGHTS OF A THIRD PARTY.
  5. No Guaranty - CookItFor.Us does not guarantee continuous, uninterrupted access to the Site, and operation of the Site may be interfered with by numerous factors outside CookItFor.Us’s control.
  6. Legal Compliance - You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of CookItFor.Us’s service and your listing, purchase, solicitation of offers to purchase, and sale of items.
  7. Severability - If any provision of this Agreement is held unenforceable, then such provision will be modified to reflect the parties' intention. All remaining provisions of this Agreement shall remain in full force and effect.
  8. No Agency - You and CookItFor.Us are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
  9. CookItFor.Us’s Service - CookItFor.Us reserves the right to modify or terminate the CookItFor.Us service for any reason, without notice, at any time. CookItFor.Us reserves the right to alter these Terms of Use or other Site policies at any time. If the alterations constitute a material change to the Terms of Use, CookItFor.Us will notify you via email to the email address in your account. What constitutes a "material change" will be determined at CookItFor.Us’s sole discretion, in good faith, and using common sense and reasonable judgment.
  10. Choice of Law - This Agreement shall in all respects be interpreted and construed with and by the laws of the State of Illinois and disputes arising under this Agreement will be adjudicated by the courts of the State of Illinois.
  11. Survival (NEED TO REVIEW SECTIONS) - Sections 3 (Fees and Services, Fees and Termination), 6 (Content, License), 7 (Information Control), 8 (Resolution of Dispute and Release), 9 (CookItFor.Us’s Intellectual Property), 10 (Access and Interference), 11 (Breach), 12 (Privacy), 13 (No Warranty), 14 (Liability Limit), 15 (Indemnity), 16 (No Guaranty), 18 (Severability), 19 (No Agency), 21 (Choice of Law) shall survive any termination or expiration of this Agreement.
  12. Notices - Except as explicitly stated otherwise, any notices shall be given by postal mail to CookItFor.Us Attn: Legal; 16 N. May Street, Unit 508, Chicago, IL 60607 (in the case of CookItFor.Us) or, in your case, to the email address you provide to CookItFor.Us (either during the registration process or when your email address changes). Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, CookItFor.Us may give you notice by certified mail, postage prepaid and return receipt requested, to the address provided to CookItFor.Us. In such case, notice shall be deemed given three days after the date of mailing.
  13. Disclosures - The services hereunder are offered by CookItFor.Us, Inc., doing business as CookItFor.Us., located at 16 N. May Street, Unit 508, Chicago, IL 60607.
